Rachael’s Rose is an independently owned family business. It is the trading name of the private partnership of J & A Weclawek and M & G Lee with VAT registration No: 926271129. These terms and conditions set out the basis of any legal matters to protect our customers and the business. If there is anything that you are unsure about, please contact us using the contact form on the website.

These terms and conditions apply to all orders placed online, by telephone, email or in writing with Rachael’s Rose. Any purchases shall be governed by English Law and any dispute will be resolved exclusively in the courts of England and Wales.  Nothing in these terms and conditions will be deemed to affect your statutory rights.

1. ITEMS AND DESCRIPTIONS

Prices, product descriptions and specifications are checked regularly, and every effort has been made to make them accurate. However no responsibility will be accepted for errors and omissions.

Any product information displayed on our website or other printed matter by Rachael’s Rose has been obtained in good faith. It is provided to give helpful additional information but cannot be taken as legally binding. All information on our website is updated regularly.

Every effort has been made to ensure the pictures and colours depicted on the website site match as closely as possible those of the actual product. However due to viewing and matching limitations some colours may vary slightly.

2. PRICING AND DELIVERY CHARGES

The prices of the items are as quoted on our website at the time you submit and pay for your order. We take all reasonable care to ensure that the prices are correct at the time. However prices (including offers) may change from time to time, but changes will not affect any order you have already placed. Where VAT is applicable, prices includes VAT which is currently 20%.

The product price does not include delivery charges. Our delivery charges will be advised to you on the website and during the check-out process, before you confirm your order. Normally we make a small postage and packing charge of £2.99 for orders with are less than £35. On orders of £35 and more then postage and packing is FREE. From time to time there may be special offers on our delivery charges. These charges and delivery times only apply to delivery addresses within the UK. 

We also arrange delivery to countries within the European Union and the standard delivery charge is £5.00 on all orders.

3. ORDERS AND PAYMENTS

We are pleased to accept orders and payment from our website. All credit/debit card transactions are subject to validation checks and are authorised by the card issuer. We use Paypal to process all payment and so accept all Mastercard, Visa, Delta, Switch, Maestro and Solo, as well as payment from another PayPal account.

If you are not able to order online, we are also pleased to take orders via email or telephone. Please see the contact page for details.

No orders will be accepted or processed without a valid card payment in the name of the registered cardholder or PayPal account. You should contact us if there are any problems with the website payment system.

By paying for an order, you guarantee that all details you provide for the purposes of ordering or purchasing goods are accurate, current and complete in all respects. In addition you guarantee that the credit/debit card or PayPal account you are using is your own and that there are sufficient funds to cover payment of the product(s) ordered.

It is an offence to use a false name or a known invalid credit card to pay for items. Anyone caught deliberately placing a fraudulent order or using someone else’s details will be prosecuted according to law.

All orders are subject to acceptance and availability.

You will receive an order acknowledgement from the website. Once processed, a confirmation email will then be sent to the email address given in your order form. This will detail the product(s) ordered, payment method, cost (including VAT and P & P), delivery name and address and usual delivery times. Please check these emails carefully and let us know as soon as possible if anything is not correct.

Non acceptance of your order may be as a result of one of the following:

  • The item(s) you ordered has become unavailable
  • The identification of a pricing or item description error

If we are not able to accept your order, we will send you an email explaining the reason why. Any funds paid will either be returned to you on request or with your agreement a replacement item of at least the equivalent value despatched.

4. OWNERSHIP OF GOODS

All goods remain the property of Rachael’s Rose until final payment of all sums in respect of those goods has been received in full by us.

5. DELIVERY

Within the UK, delivery is usually by 2nd Class Mail. We aim to despatch orders within 2 working days (Monday to Friday) from the date of the order. The delivery period is therefore no more than 4 to 5 working days, but the exact date cannot be guaranteed. Please note that weekends and Bank Holidays are not classed as working days for our on-line facility. Please contact us if there are problems with the delivery.

If you are ordering more than one item, on very rare occasions goods may be despatched separately, but at no additional cost to you other than what has been quoted on the website.

6. RETURNS AND EXCHANGES

None of the following conditions affect your statutory rights when goods are faulty or are not as described.

We hope that you will be satisfied with anything that you buy from us. However if you decide to return an item for exchange or you have decided not to keep it, you should contact us within 14 days from the day after the delivery date. So that we can process a refund or exchange of an item, it MUST be in unused and fully re-saleable condition. This includes all its original labels and tags.

For faulty goods or items that develop faults not considered by us to be caused by misuse or damage, you will be entitled to a full refund or replacement at our cost. If you consider an item to be faulty, please contact us straight away so that we can resolve the matter. Any claim must be made within a maximum period of three months from delivery.

Returns can be made by post or in person at one of our shops.

If planning to send by post, please use the contact form on the website or write to us by replying to the email address on the order acknowledgement to explain the reason for the return and whether you would like a refund or a replacement. Please include your name and order number. We will email you back with further instructions. Please note we will only refund the price of the item to the purchaser or exchange the product once it has been received by us.

If you wish to return the item in person, please also bring a copy of the email order to one of our shops in East Devon (for addresses see website). Please tell the shop assistant that you bought the item online and they will process your request for you by exchanging the item or arranging for a refund.

We will refund fully the return postage when a product is faulty or damaged, but not when an item is simply unwanted. Please ensure that you enclose a copy of the postage receipt. If it is simply unwanted, you will have to pay the return cost of postage for the returned item.

7. PRIVACY POLICY

We have a clear privacy policy which is part of these overall terms and conditions. The policy covers areas such as:

10. ACCEPTANCE

These Terms and Conditions govern our relationship with you.

Nothing in these Terms and Conditions shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.
